These Terms of Service (the “Terms”) govern your access to and use of the orchit website, applications, and related services (collectively, the “Service”) provided by orchit (“orchit,” “we,” “us,” or “our”).
By (a) creating an account, (b) starting a free trial, (c) clicking “I agree” (or similar), or (d) accessing or using the Service, you agree to be bound by these Terms.
1. Who May Use the Service
You must be at least the age of legal majority in your place of residence (or have parental consent where permitted) and capable of forming a binding contract. You may use the Service only in compliance with these Terms and all applicable laws.
2. Accounts & Security
You are responsible for all activity under your account. Keep your credentials confidential and notify us immediately of any unauthorized use. We may require verification information and may disable or suspend access if we suspect a breach of these Terms or misuse.
3. Plans, Trials, and Subscriptions
Free/Trial Access. We may offer free or trial features with limitations. We may modify or end trials at any time.
Paid Plans. Fees, billing intervals, and plan limits are shown at purchase or in your workspace settings. Unless stated otherwise, paid plans renew automatically for the same term and at the then-current price.
Taxes. Fees are exclusive of taxes; you are responsible for any applicable taxes.
Refunds. Except where required by law, payments are non-refundable.
4. Acceptable Use
You will not (and will not permit anyone to):
- a) reverse engineer, decompile, or attempt to derive the source code of the Service;
- b) access the Service to build a competing product or service;
- c) interfere with or disrupt the integrity or performance of the Service;
- d) upload malware or engage in activity that is harmful, fraudulent, infringing, or illegal;
- e) exceed plan limits or circumvent technical restrictions;
- f) misrepresent your identity or affiliation;
- g) use the Service, including its AI features, to create or share sexually explicit content or non-consensual intimate imagery.
5. Customer Content
“Customer Content” means any data, text, files, images, code, or other materials you (or your users) submit to the Service. You retain ownership of your Customer Content. You grant orchit a worldwide, non-exclusive license to host, store, process, transmit, display, and otherwise use Customer Content as necessary to provide and maintain the Service and as directed by you.
You are responsible for the accuracy, quality, and legality of Customer Content and for obtaining all necessary permissions. If you submit feedback or suggestions, you grant orchit a perpetual, irrevocable, royalty-free license to use them without restriction
6. Privacy
Our collection and use of personal data is described in our Privacy Policy located at orchit.ai/privacy-policy. You agree to that policy. If you are subject to specific data protection laws (e.g., GDPR), contact us for any required agreements (e.g., a data processing addendum).
7. Service Changes & Availability
We may modify, discontinue, or add features to the Service from time to time. We will use commercially reasonable efforts to provide the Service with minimal interruptions, but we do not guarantee that the Service will be uninterrupted or error-free. We may apply maintenance windows, updates, and emergency changes.
